Abstract

Background. The purpose of the work is to consider the problems related to fai¬lure of duties on education of minors on the basis of the analysis of court practice.
Materials and methods. This article was prepared on the basis of the analysis of norms of the Criminal code of the Russian Federation, decisions of courts of Penza, Volgodonsk, Kursk, etc. in order to address issues related to failure of duties on education of minors. When writing the article the follwoing methods were used – logical, comparative-legal, formal-legal.
Results. The article is devoted to the study of issues related to failure of duties on education of minors. The authors analyzed the types of liability for this kind of fai¬lure, describes the characteristics and problems of qualification of article 156 of the Criminal code of the Russian Federation “Failure of duties on education of minors” and researched court rulings, conclusions and proposals on improvement of the norms of article 156 of the Criminal code.
Conclusions. The authors concluded the following: at the present time the necessity of legislative regulation of activities on prevention of domestic violence and child abuse not only by criminal-legal means, but also by actions of other sectoral legislations is quite an important issue.
